By agreeing to the aforementioned and subsequent acknowledgment of the remainder of said disclaimer, you are affirming that you are, the equivalent or of greater academic certification, a Medical Laboratory Technologist or Technician. ALL concerned products are for laboratory and research activities exclusively.

Buyer agrees that any material produced with products from Surge Nutraceuticals shall not be adulterated or misbranded within the governing law of the Federal Food Drug and Cosmetic Act and shall not be materials which may not under Sections 40d. 505. or 512 of the Act be introduced into interstate commerce.

Buyer has the responsibility to verify the hazards and to conduct any further research necessary to learn the hazards involved in using products purchased from Surge Nutraceuticals.

In compliance with Federal Law, this product is NOT intended to be submitted into interstate commerce by an uncertified, unlicensed, or unregistered entity.

Buyer agrees to comply with instructions by supplier relating to the use of the products and not violate the expressed prohibitive use of said products in any manner.

In no event shall Surge Nutraceuticals or any of its affiliates be liable for special incidental or consequential damages as purchase claims in contract, negligence, strict liability, or otherwise. Surge Nutraceuticals absorbs no liability in the form of compensatory damages or any other form. By continuing, you resign individual right to litigation against Surge Nutraceuticals (surgenutraceuticals.com). Buyer agrees to indemnify and hold Surge Nutraceuticals harmless from all claims, expenses, losses, and liability of any nature whatsoever arising out of Buyer's mishandling and or misuse of any product sold here.

Surge Nutraceuticals will not produce nor sell products that are scheduled or controlled substances in Canada or in the United-States.

Buyer has the responsibility for fully researching and complying with the state and federal regulations of their own country of residence.

Buyer agrees to indemnify and hold harmless Surge Nutraceuticals and its present and future suppliers, agents, owners, shareholders, and employees, as the case may be, for and against any and all losses, damages, and expenses, including legal fees and other costs of defending any action that Surge Nutraceuticals may sustain or which may occur as a result of any claim of negligence of contract or other claims or theories of law by himself, his officers, agents, or employees, his customers or other persons, whether direct or indirect in connection with the unsafe, improper or illegal use, or unintended use of any products provided.

Buyer will adopt and use all necessary safety precautions and will abide by all local, state/province, and government regulations in accordance with the use of any product or service provided by Surge Nutraceuticals.

Shipping & Delivery

At this time, Surge Nutraceuticals ships merchandise to locations all over the globe. We offer domestic and international shipping through various carriers and methods. The risk of loss and title for all merchandise ordered on this website passes to the carrier when the merchandise is delivered to the designated shipping carrier.

Sales Tax

Surge Nutraceuticals charges sales tax based on the applicable provincial sales tax rate and the location to which the order is being shipped.
Miscellaneous

Governing Law

In the event of litigation, both parties agree that the Law of the Province of business registration of Surge Nutraceuticals shall apply and both parties shall consent to the jurisdiction of said Provinces courts, or in the event of diversity of citizenship, the Supreme Court of Canada. Both parties expressly waive a trial by jury.
